Terms of Service

EvenBook is a software product owned and operated by Beardsley Holdings LLC. These terms apply to the public website at even-book.com and to the EvenBook owner portal at owners.even-book.com. By using either, you agree to them.

Who the portal is for

The owner portal is made available to property owners, association members and staff of a property-management company or owners' association that has a service agreement with EvenBook (the "customer"). Your access exists because the customer listed you as an owner, member or staff user. The customer decides who is listed and can ask us to add or remove access at any time.

Signing in

You sign in with a Google or Microsoft account, or with a one-time link we email to the address the customer gave us. Keep that account and mailbox secure: anyone who can use them can see what you can see. Do not share sign-in links. Tell us or the customer right away if you think someone else has used your access.

What the portal shows

The portal displays information supplied by the customer and by the customer's systems, such as residence details, association dues, account balances, documents, reservations and rental statements. The customer's own accounting records remain the official record of what you owe or are owed. If a figure in the portal looks wrong, raise it with the customer; EvenBook will correct the portal once the customer confirms the right figure. EvenBook does not provide accounting, tax, legal or investment advice.

Payments

Where online dues payment is offered, payments are processed by a third-party payment provider under that provider's terms. A payment is complete when the provider confirms it, and it is applied to your account as described in the portal. Processing fees, if any, are shown before you confirm a payment.

Acceptable use

• Use the portal only to view and manage information about residences you own or are authorised to manage.
• Do not try to access another owner's information, probe or overload the service, or copy data by automated means.
• Do not upload anything unlawful, infringing or harmful.
• Do not resell or sublicense access to the portal.

Your content

Documents, ballots, requests and messages you submit through the portal remain yours or the customer's. You give EvenBook permission to store and display them so the service works. The customer's service agreement governs how long customer data is kept.

Availability and changes

We work to keep the service available and accurate but do not promise it will be uninterrupted or error-free. We may change or withdraw features, and we may suspend access to protect the service, its users or the customer. We will give reasonable notice where we can.

Intellectual property

EvenBook, its software, design and content are owned by Beardsley Holdings LLC or its licensors. These terms do not give you any right to them beyond using the service as intended.

Disclaimer and limitation of liability

The service is provided "as is". To the fullest extent permitted by law, Beardsley Holdings LLC disclaims all warranties, express or implied, and is not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue or data, arising from the service. Our total liability to any user of the portal is limited to one hundred US dollars. Nothing in these terms limits liability that cannot be limited by law. The service agreement between EvenBook and the customer governs EvenBook's obligations to the customer.

How we handle personal information is described in our Privacy Policy.

Governing law

These terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts located in Virginia, unless the law where you live requires otherwise.

Changes to these terms

We may update these terms as the service changes. We will post the new version here and revise the effective date above. Continued use after a change means you accept the updated terms.
